DOJ Threatens to Take DACA to SCOTUS
The Trump administration has filed a letter asking the 9th Circuit Court of Appeals to issue a ruling on their recission of the Obama-era DACA policy by the end of the month. If it doesn't, the administration says it will go straight to the Supreme Court -- where Justice Brett Kavanaugh’s recent appointment gives the administration a conservative majority. A district court judge temporarily blocked the administration from unwinding the program pending the resolution of the litigation. The 9th Circuit heard arguments in May but has yet to issue an opinion. SCOTUS in February declined to hear an immediate appeal in the case, saying they assumed the 9th Circuit would “proceed expeditiously to decide this case," according to the letter. "The district court’s injunction has now been in place for more than nine months and, unless either this Court or the Supreme Court promptly intervenes, it could remain in force for at least another year, given the Supreme Court’s argument calendar," the government wrote.
